Resurrection of dead son...or is it?

MALDA, 13 JAN: Giyasuddin Momin had been declared dead by no other than his father a year ago. Suspecting foul play and on the basis of the father’s complaint, police had arrested one person in connection with the murder as well. Giyasuddin returned from the land of dead today to depose before the chief judicial magistrate in Malda and to save the accused.


Giyasuddin ( 16), a resident of Momintala in Kaliachak police station, was missing since 7 November 2008 after a quarrel between his father Mr. Galli Momin and neighbour Mr. Sabiruddin Momin over a plot of land.


Mr Sabiruddin Momin had reportedly threatened Giyasuddin with dire consequences following the quarrel with his father. His father lodged a missing complaint with the Kaliachak police station on 13 November after he went missing from 7 November. Meanwhile, the police came across a decomposed male body in the Pagla River on 29 November in Kaliachak and registered a case of unnatural death (no 41/ 2008). Residents of Momintala village including Giyasuddin’s father claimed that body of that of the missing Giyasuddin.


Based on the statement of the father and villagers, the police thereafter started a case (no 36/2009) on 17 January 2009 against the alleged murder of Giyasuddin. Seven persons including the neighbour Mr. Sabiruddin Momin were accused on charges of conspiracy and murder under Sections 302, 201 and341 IPC in the case. Although the police could not the arrest others, they arrested Mr. Sabiruddin Momin on 20 April 2009. The arrested person was sent to jail but, the granted his bail plea in July 2009.


The episode took a new turn after a group of migrant workers from the village spotted Giyasuddin in Mumbai in September 2009. They informed him about the incidents that had followed his alleged murder. Scared with what had happened Giyasuddin fled Mumbai to take up a hob in New Deli. Finally, the accused Mr. Sabiruddin Momin’s family members and migrant workers traced him down in Delhi and brought him to Malda Court.


The CJM has asked police to conduct a fresh inquiry and submit the report on 21 January. The Malda SP Mr Bhuban Mandal told reporter: “Giyasuddin’s father, who had identified the body hand misled the police by claiming that the body was his son’s”.
