Illegally detained prisoner released


MALDA, Jan. 6: The Berhampore Central Jail authority in Murshidabad today freed Ananda Das, who was ‘illegally detained’ in the jail, following an order from the chief judicial magistrate, Malda court, Mr B N Singh.


Das, with the help of the Malda Ramkrishna Mission, today appealed to the state and national human rights commission for compensation of his illegal detention in jail. Commenting on the matter, the chief of the Malda Ramkrishna Mission, Swami Divyananda, said: “Ananda was languishing in jail for nearly three years and six months. He has demanded Rs 10 lakh as compensation.” Ananda will also apply to the chairman of the state legal services, Justice Mr Pinaki Chandra Ghosh, seeking justice for ‘illegal detention’ under Article 226 of the Indian Constitution, Swami Divyananda said.
It may be noted that though the former Malda district judge Mrs Keya Basu had reduced Das's punishment from seven years to three years’ rigorous imprisonment on 8 September 2003, the verdict had not been communicated to the jail authorities by the Malda court.

Das was judged guilty under Section 326 of the Indian Penal Code for assaulting his cousin Thagen Das at Gobindapur village in Malda on 25 August 1984. Yesterday, when the Malda CJM, Mr B N Singh ordered Das's release, the Malda court sent the copy of the order to the Malda jail by a special messenger. The Malda jail authorities sent another special messenger to the Berhampore central jail last evening for Das's release.
